Terms of Use
These terms govern your use of Hailmo (app.hailmo.com), operated by Respiresoft LLC (32 N Gould St, Sheridan, WY 82801, United States). By creating an account, you agree to them.
The service
Hailmo lets a person and a business message each other, keep a public business directory listing, send push notifications, and share photos, videos, voice notes, files and locations as message attachments. Messaging, the directory and orders cost nothing, and Hailmo takes no payment for them. The one exception is the optional Hailmo assistant, which has paid plans and packs: the price, including any tax, is shown before you buy. They are sold through Link, part of Stripe, which is the seller of record: it takes the payment on its own page, handles the tax and sends your receipts, and your card statement shows LINK.COM. Plans, renewals and refunds are described under “Plans, renewals and refunds” below. A business may take orders from its customers in a chat and the customer settles with the business directly; businesses may not use Hailmo to sell digital goods or credits.
Who can use Hailmo
You must be at least 16 years old to have a Hailmo account, or older if the law of your country requires it. Business accounts and the AI assistant are for people who are 18 or older. When you sign up, you confirm that the date of birth you give is true. If we learn that an account belongs to someone who is not allowed to use Hailmo, we may close it.
Your account
You are responsible for the accuracy of the information on your account and for keeping your password secret. You are responsible for what is sent from your account.
Acceptable use
By using Hailmo, you agree not to post objectionable content or abuse other people. We act on reports.
Objectionable content and abusive conduct include, without limitation: sexual content involving a child or the exploitation of a child; sharing intimate images of someone without their consent, or threatening to; harassment, bullying, stalking and threats; hate speech and content that promotes violence or terrorism; scams, fraud and impersonating another person or business; spam and unwanted mass messages; selling illegal goods or services; and anything else that is illegal where you or the other person live.
Any message, conversation or user can be reported from inside the app, and any user can be blocked from inside the app — both are always available, not hidden behind a settings menu nobody finds. To report illegal content, use Report in the app or write to the contact address at the end of these terms, which is also our point of contact for authorities.
A report is reviewed by our staff. We may remove content or limit, suspend or close an account that breaks these terms, up to permanent removal; this applies equally to a personal account and to a business account. We tell the person what we did and why, unless the law stops us or telling them could put someone at risk, and they can appeal by writing to us within 14 days.
Content you send
You keep ownership of what you send. You give us only the permission we need to store it, transmit it and show it to the people you chose, and to run safety checks on content that is reported to us or that is not end-to-end encrypted. A message you send in a business conversation is also kept as part of that business’s own record, the same way a message sent to a shared business mailbox would be, and an order you place is sent in the clear to the business as its record of the sale — see the Privacy Policy for exactly how that is stored. If you use the optional Hailmo assistant, you agree first that what you write to it is sent to the AI provider the assistant screen names; do not send it anything you do not want processed there. To report content that infringes copyright, write to the contact address at the end of these terms and tell us where to find it.
Plans, renewals and refunds
A plan renews every month at the price shown until you cancel in Settings; an extra pack is paid once. You get a refund where the law gives you a right to one, and whenever Respiresoft chooses to give one. If you are a consumer in the European Union or the United Kingdom, you have 14 days from buying to withdraw from a plan or a pack, unless you asked at the time of purchase for it to start straight away and agreed to lose that right once it has been fully provided. Link, part of Stripe, is the seller: it sells the plans and packs and handles withdrawals and refunds, while Respiresoft provides the assistant. To withdraw or to ask for a refund, ask Link; if you cannot reach it, write to the contact address at the end of these terms and we will pass your request on. This does not limit any right the law of your country gives you.
If you use Hailmo for a business
If you open or manage a business account, you confirm that you are 18 or older and allowed to bind the business to these terms. You must keep your listing accurate, and you may not use Hailmo to sell digital goods or credits. The orders and conversations a business keeps are the business's own record, and the business is responsible for how it uses them. Hailmo keeps them on the business's behalf: only to provide the service and on the business's instructions given through the app and its settings; the data is the messages, orders and customer details in the business's account; it is kept while the business keeps them, as the Privacy Policy describes; and the services that help us are those named under “Who processes your data”.
Our responsibility
We provide Hailmo with reasonable care and skill. We do not promise that it will always be available or free of errors. Nothing in these terms limits our liability where the law does not allow it to be limited, for example for death or personal injury caused by our negligence, for fraud, or your legal rights as a consumer. Subject to that, our liability to you for a claim about the free service is limited to US$100, and for a claim about a paid plan or pack to what you paid for it in the 12 months before the claim.
Governing law
These terms are governed by the laws of the State of Wyoming, United States. If you use Hailmo as a consumer, you keep the mandatory consumer rights of the country where you live, and you can bring a claim in the courts there. These terms do not require you to go to arbitration.
Suspension, removal and account deletion
We may suspend or remove an account that violates these terms. You may delete your own account at any time, from inside the app (Settings → Data & storage) or from the public account-deletion page — see the Privacy Policy for what is deleted immediately and what is retained.
Changes to these terms
If we make a material change to these terms, we tell you in the app or by email at least 30 days before it applies. If you do not agree, you can delete your account before then. Smaller changes are published on this page with a new “last updated” date.
